First Name* Last Name* Terms of Use: BY USING THE DIRECT CONNECT SERVICE (THE "DC SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE SERVICE. The DC Service is a remote support tool that allows consumer technical support of Belkin International, Inc. and its subsidiaries, including, without limitation, Linksys LLC (collectively, "Belkin") agents to view and control your computer remotely to perform ordinary technical support procedures. In order to begin the support session and access your computer, you will be asked to install DC client software onto your computer with your permission. You understand that once the DC client software is installed and support session initiated, a Belkin consumer technical support agent will take control of your computer and will be able to view, transfer and modify files and applications on your computer and perform other diagnostic and support tasks as needed. You will be able to watch all actions taken by the agent during the support session on your computer monitor. You also will have the ability to terminate the support session at any time. At the end of the support session, you can delete the DC client software or ask the agent to delete it. You hereby acknowledge that (i) Belkin may, in its sole discretion, elect to record your support session for reference as part of your service record and/or as such recording may be relevant in future support sessions with you, or for other internal business purposes of Belkin, and (ii) Belkin shall have no obligation to store or otherwise retain any such recordings, and that such recordings may be deleted by Belkin at any time without notice, or as part of any scheduled deletion pursuant to Belkin’s data retention policy at such time. Subject to these Terms of Use, Belkin grants you a nonexclusive license to use the DC client software solely for the purposes of receiving the DC Service. This license may not be sublicensed, and is not transferable. The DC client software contains copyrighted materials of Belkin or its suppliers. You acknowledge that you are not permitted to copy or modify the DC client software or decompile, decrypt, reverse engineer or disassemble the DC client software (except to the extent expressly permitted by law notwithstanding this provision), and you further acknowledge that you are not permitted to disclose or make available such copyrighted material in any form to any third party. Title to and ownership of the DC client software will remain solely with Belkin or its suppliers, as the case may be. THE DC SERVICES AND DC CLIENT SOFTWARE ARE PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. BELKIN SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. You also may have other rights which vary by jurisdiction. IN NO EVENT WILL BELKIN OR ANY OF ITS EMPLOYEES, SUPPLIERS OR OTHER PERSONNEL, BE LIABLE FOR ANY DAMAGE TO YOUR COMPUTER, FILES OR APPLICATIONS; LOST DATA, REVENUE OR PROFIT; OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, REGARDLESS OF CAUSE (INCLUDING NEGLIGENCE), ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE DC SERVICE OR DC CLIENT SOFTWARE, INCLUDING, WITHOUT LIMITATION, ANY DAMAGE ARISING FROM OR RELATED TO ANY CHANGES, DATA ACCESS OR OTHER OPERATIONS OR ACTIONS PERFORMED WHILE CONTROL OF YOUR COMPUTER WAS GRANTED TO BELKIN’S CONSUMER TECHNICAL SUPPORT, EVEN IF ANY OF BELKIN’S EMPLOYEES OR OTHER PERSONNEL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL BELKIN’S LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE BELKIN PRODUCT FOR WHICH THE DC SERVICES REQUESTED. The foregoing limitations will apply even if any remedy under this Agreement fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. These Terms of Use will be governed by and construed in accordance with the laws of the State of California, without reference to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods will not apply. If any portion of these Terms of Use is found to be void or unenforceable, the remaining provisions will remain in full force and effect. These Terms of Use constitute the entire agreement between you and Belkin with respect to the DC Services and the DC client software and supersede any conflicting or additional terms.
